Tracy's Ten Cents - Book Review: 'Water 4.0: The Past, Present, and Future of the World’s Most Vital Resource'

  G. Tracy Mehan III, who is now AWWA's new Executive Director of Government Affairs, was kind enough to send me his review of David L. Sedlak's book, Water 4.0: The Past, Present, and Future of the World’s Most Vital Resource.

I should add that Tracy is a skilled writer and reviewer and knows how to write a review. It will appear in an upcoming issue of The Environmental Forum published by the Environmental Law Institute.

It is a stimulating and challenging book.  As an expert in the field, I welcome your comment on the book and/or my review.  Dr. Sedlak is clearly pushing the envelope in terms of the future of utilities and water management in the years ahead.

To whet your appetite, here are the first few paragraphs:

David Sedlak, a Berkeley engineering professor, has written a challenging, well-informed history of water and wastewater treatment. He employs a historical method in service of his argument for moving beyond massive, centralized treatment systems toward a more pluralistic, dis- tributed system that takes advantage of modern innovations in membrane, information, and other technologies, including the emulation of more natural flow regimes in treatment processes.

Sedlak is definitely of the school that rejects the very idea of wastewater, in reality water that is wasted. It should be reused or recycled. And, rather than simply transporting stormwater off site and into the sea, it should be viewed as a precious commodity to be treasured or retained and treated on site through infiltration, evapotranspiration, or reuse. Conservation and steward- ship should be elevated in the hierarchy of utility managers’ values over a single-minded focus on volumetric sales. This, in turn, will necessitate the reinvention of how water services are priced. 

He sees climate change,with its erratic precipitation patterns (too much or too little), as a primary driver of this imperative to get beyond the traditional water grid. Other drivers include a growing economy and population; ageing infrastructure; escalating costs of water capture, transport, storage, and treatment; and tena- cious resistance to rate or price increases by local leaders and citizens whether it be for upgrading infrastructure or conservation.

Report: 'Unbundling Water Rights: Blueprint for Development of Robust Water Allocation Systems in the Western US'

Renee Martin-Nagle sent me this pioneering report from Duke University's Nicholas Institute by Australian water guru Michael Young and others, Unbundling Water Rights: A Blueprint for Development of Robust Water Allocation Systems in the Western United States.

Renee noted that the plan advocates estimating a basin’s runoff (both surface water and groundwater) and replacing water rights with water shares.

Here is the summary:

This report lays out a blueprint for transitioning to robust water rights, allocation, and management systems in the western United States—a blueprint ready for pilot testing in Nevada’s Diamond Valley and Humboldt Basin (map below). If implemented, the blueprint’s reforms would convert prior appropriation water rights into systems that keep water withdrawals within sustainable limits, allow rapid adjustment to changing water supply conditions, generate diverse income streams, and improve environmental outcomes.

The blueprint’s essential element is unbundling of existing water rights. In law and economics, property rights are often described as a bundle of sticks. When applied to a water right, unbundling involves separating an existing right into its specific, component parts. In an unbundled system, each part is defined and can be managed and traded separately. During the unbundling process, as proposed here, the value of each component is enhanced, and the taking of property rights is avoided.

Unbundling brings clarity to water rights and reveals the true value of the water, because willing buyers and sellers are able to trade with one another with dramatically reduced transaction costs. “Liquid markets” emerge. Shares, a primary product of the unbundling, can be used to finance innovation, and opportunities for improving environmental outcomes are increased through the transparent value of water rights shares and allocations.

If water managers in Nevada find that an unbundled water rights system is more desirable than the current system, they can use this report’s proposed reforms and schedules to facilitate the transition to it. Although the state engineer and governor’s office may have sufficient perquisites to proceed without the support of new legislation, implementation would be easier if underpinned by legislation.

A water expert is applying lessons learned in Australia's "millennium drought" to see if the strained and antique water rights laws in the western United States can be repaired.

Academics have often pointed to Australia as a good example for California and other Western states that are prone to drought and to overallocation of their water supplies. Now, one of Australia's top water experts is arriving with a new strategy proposing water rights reform in two areas of Nevada.

University of Adelaide professor Michael Young was an architect of Australia's current water system, credited with bringing his country's water use into balance with its supplies. One of the keys to reforming it was the concept of clarifying water rights by allocating them according to a basin's estimated runoff, which is calculated annually, rather than by handing out permanent rights to guaranteed amounts of water (Greenwire, June 25).

Young is hoping to test the legal receptivity of the approach in the United States with two pilot projects in the central region of Nevada, which he visited earlier this summer.

Diamond Valley, in the north-central part of the state, has a relatively insular water system, with about 110 users drawing from a groundwater basin that is habitually overpumped. The U.S. Geological Survey estimates it will be depleted in 30 years. Young's other subject, the Humboldt River Basin, is a much more complex system, stretching more than 330 miles east of Reno and encompassing both surface water and groundwater.

"I'm fairly confident it's doable to move to a new system," he said in a July interview. "Bit like deciding to fly to the moon: easy to recommend, much harder to work out what has to be put in place to get liftoff."

Converting rights to more tradable shares of what's there

In the strategy, Young and his co-authors lay out what is needed to set up a five-year pilot program for each of the regions, including a formula for recalculating water rights, recommendations for government, and even a list of terminology that is more likely to gain traction with water users.

Most crucial is the conversion of rights into shares, which represent a proportion of the available water, rather than a permanent quantity. Senior water rights holders can receive a larger amount of shares than junior users, and shares can be assigned different priority tiers in water systems that have a great deal of annual variability, so buyers can manage their risks. Then the government allocates water as it becomes available, rather than the U.S. practice of predicting allocations months in advance.

Shareholders can sell their allocations without giving up the underlying rights, or they can sell the shares themselves. Brokers and traders can also own allocations without owning shares or land. "Unbundling" rights in this way makes trading much simpler and cheaper, which increases the value of water, Young argues. That also spurs investment in water-saving technology.

"In the 1990s, Australian water specialists were always going off to Israel to look at drip irrigation," he said. "By 2003, anybody who said they wanted to go to Israel to learn how to manage water would be laughed at because all the smart technologies were being demonstrated in Australia."

Other necessary reforms include improving water metering and accounting systems around water rights, so that water can change hands as easily as money. Young recommends a single statewide registry similar to the system used for land ownership.

'You design systems that learn'

He also stresses the importance of a straightforward water resource management plan for each water source that sets out clear rules -- for example, specifying exchange rates between basins -- in order to limit challenges to proposed transfers.

In Australia, "one of the things we decided was very important was to be able to trade water from one location to another within two to three days," he said. "And there's no opportunity for appeal. If you get the calculation wrong, you revise the exchange rate; you don't undo it. You design systems that learn."

Young said that legislation would also help bolster the new systems against legal challenges, which aren't as common in Australia. But Australia's drought was also so severe that it aligned public opinion in favor of reform.

"In 2000, we were where California is now," he said. "Imagine next year is even dryer, and next year is even dryer again. That's what happened. It becomes very easy if you're a governor, or a prime minister or president, to step in and say, 'We're going to fix this, and we're going to fix it properly.'"

Young's work was published by Duke University's Nicholas Institute for Environmental Policy Solutions and was funded by the Pisces Foundation, the Walton Family Foundation, the S.D. Bechtel Jr. Foundation and the Rockefeller Foundation.

I have not read the report in its entirety, but the approach is certainly is worth trying as we grapple with an outmoded system of water rights. I hope that Nevada has the wisdom to implement the pilot studies. The Humboldt Basin would be a particularly important study because of its size and complexity. 

Could be a game-changer.
