CRS Report: 'Energy and Water Development Appropriations - Nuclear Weapons Activities'

As usual, I'm a fool for any legitimate report that deals with energy/water/nuclear weapons. Just picked it up from my years in Nevada. I'll never forget my first swig of tritiated water during an infiltration test on the Nevada Test Site.

Summary
The annual Energy and Water Development appropriations bill funds civil works projects of the Army Corps of Engineers, the Department of the Interior’s Bureau of Reclamation, the Department of Energy (DOE), and several independent agencies. The DOE budget funds the National Nuclear Security Administration (NNSA), a semiautonomous agency within DOE. NNSA operates three programs: Defense Nuclear Nonproliferation, Naval Reactors, and Weapons Activities. The last is the subject of this report.

The Weapons Activities account supports U.S. nuclear warheads, provides the materials and components for those weapons, and sustains the infrastructure that supports that mission. They provide for “the maintenance and refurbishment of nuclear weapons to continue sustained confidence in their safety, reliability, and performance; continued investment in scientific, engineering, and manufacturing capabilities to enable production and certification of the enduring nuclear weapons stockpile; and manufacture of nuclear weapon components.”

NNSA’s budget request for FY2021 seeks $15.6 billion for Weapons Activities, an increase of 25% over the enacted funding of $12.6 billion in FY2020, within a total budget of $19.8 billion for NNSA. The House Appropriations Committee included $13.7 billion in its version of the FY2021 Energy and Water Development appropriations bill (H.R. 7613, H.Rept. 116-449).

NNSA has reorganized and renamed its programs areas in its FY2021 budget request. The four main programs, each with a request of over $2 billion for FY2021, include the following:

 Stockpile Management, which contains many of the projects included in Directed Stockpile Work from previous years, supports work directly on nuclear weapons. These include life extension programs, warhead surveillance, maintenance, and other activities. The FY2020 appropriation for the programs in Directed Stockpile Work that will now be a part of Stockpile Management was $3.7 billion. NNSA has requested $4.3 billion for them in FY2021.
 Stockpile Production programs focus on maintaining and expanding the production capabilities for the components of nuclear weapons that are critical to weapons performance. According to NNSA, these include primaries, canned subassemblies, radiation cases, and non-nuclear components. The FY2020 appropriation for programs that are now included in this program area was $1.6 billion; NNSA has requested $2.5 billion for them in FY2021.
 Stockpile Research, Technology, and Engineering replaces the Research, Development, Test and Evaluation program area. These programs provide the scientific foundation for science-based stockpile decisions. The FY2020 appropriation for programs that are now included in this program area was $2.6 billion. NNSA has requested $2.8 billion for them in FY2021.
 Infrastructure and Operations maintains, operates, and modernizes the NNSA infrastructure. It supports construction of new facilities and funds deferred maintenance in older facilities. The FY2020 appropriation for programs that are now included in this program area was $3.2 billion. NNSA has requested $4.4 billion for FY2021.

Weapons Activities also includes several smaller programs, all of which are described in this report: Secure Transportation Asset, Defense Nuclear Security, Information Technology and Cybersecurity, and Legacy Contractor Pensions.

The Nuclear Security Enterprise
Responsibility for U.S. nuclear weapons resides with both the Department of Defense (DOD) and the Department of Energy (DOE). DOD develops, deploys, and operates the missiles and aircraft that can deliver nuclear warheads. It also generates the military requirements for the warheads carried on those platforms. The National Nuclear Security Administration (NNSA), a semiautonomous agency within the Department of Energy, oversees the research, development, test, and acquisition programs that produce, maintain, and sustain the warheads. NNSA is also responsible for storing and securing the warheads that are not deployed with DOD delivery systems and for dismantling warheads that have been retired and removed from the stockpile.

Congress authorizes funding for both DOD and NNSA nuclear weapons activities in the annual National Defense Authorization Act (NDAA); it funds the NNSA budget through the Energy and Water Development Appropriations Act. This report focuses on the portion of the Energy and Water Development Appropriations Act that funds NNSA’s nuclear weapons activities.

TGIF! Weekly Water News Summary 31 October - 6 November 2020

Pyotr Ilyich Tchaikovsky died in St. Petersburg, Russia, on this day in 1893 at the age of 53. The cause of death was listed as cholera - from drinking contaminated water a few days earlier. Mike McGuire goes into this in his This Day in Water History blog post.

I loved playing his overtures (on an alto saxophone, no less) when I was in my high school symphonic band.

Just in - the Special Master hearing the MS v. TN groundwater dispute, Eugene E. Siler, Jr., will recommend to the U.S. Supreme Court that the groundwater in question is an interstate resource; Mississippi's case be dismissed; and that equitable apportionment be applied.

Memo to UN-Water, IGRAC, World Water Council and Senegal: Combine the Groundwater Summit and 9th World Water Forum in 2022!

The 9th World Water Forum (9WWF) organized by the World Water Council and the
Republic of Senegal, has been postponed a year and moved to 21-26 March 2022. 22 March 2022 is the celebration of International World Water Day and will devoted to groundwater, Neno Kukuric, who heads the International Groundwater Resources Assessment Centre, will help celebrate the this day by holding a Groundwater Summit:

In 2022, the International World Water Day (WWD) will be dedicated to groundwater. As usual, the World Water Development Report (WWDR) for that year will be about the same topic: groundwater. Groundwater Summit is envisaged as a central celebration of the WWD, and the venue for launching the WWDR. During the Summit, Catalogue on Groundwater Management and Governance will be introduced and made available online for worldwide use.

Groundwater is a major water-supply source, whilst also sustaining aquatic ecosystems and maintaining baseflow in rivers, and being a critical storage element for climate-change adaptation. Despite these impressive facts, groundwater (being invisible) is ‘out of mind’ for most people. At the same time, water scarcity is increasing, already affects about 2.7 billion people around the world for at least one month per year. As surface water availability decreases (due to human activities and climate change), reliance- and pressure on groundwater is growing. Yet we still do not know sufficient about the state of groundwater resources globally and we do not manage aquifers well enough.

In order to increase awareness about groundwater, international water community decided to dedicate a World Water Day in 2022 to this precious resource. Groundwater will also be a topic of a World Water Development Report in the same year. The report will present the state and trends of groundwater resources in order to make their role more understandable and visible. The slogan of the WWD and the WWDR in this Year of Groundwater will be: Groundwater – Making invisible visible.

The Groundwater Summit (22-23 March 2022) is envisaged as a central celebration of the WWD, and the pivotal venue for launching the WWDR (on 22^nd March). It will bring together scientists, policy makers and practitioners and it will focus on improving a science-policy-practice interface.

Neno has not yet announced a venue, so I have a suggestion: why not use the 9WWF venue in the Dakar area and integrate the Summit with the 9WWF? This would provide a boost to the Groundwater Summit and expose IGRAC's message to a much larger audience. The 9WWF attendance would no doubt be enhanced. It would also introduce an important topic - groundwater - the reservoir for so much (~95%) of Earth's liquid freshwater. Groundwater is a topic that has not been adequately covered by previous WWFs.

This integration would not be easy. Planning for the 9WWF is well underway - the action groups (and I belong to one) have already submitted the first round of reports. But recently things have bogged down, so why not act now? I am not asking the 9WWF folks to give away the store and alter what they have done. Just add something that would enhance their meeting, increase attendance and impart an important message to all WaterWonks.

If it is too difficult to integrate the events and their programs, make the Summit a 'side event'!

The Water Resources Council and President Trump's Water Subcabinet: Déjà Vu All Over Again?

On 13 October 2020, President Trump issued an Executive Order titled: Executive Order on Modernizing America’s Water Resource Management and Water Infrastructure. Here's the purpose:

Section 1. Purpose. Abundant, safe, and reliable supplies of water are critical to quality of life for all Americans, fueling our economy, providing food for our citizens and the world, generating energy, protecting public health, supporting rich and diverse wildlife and plant species, and affording recreational opportunities. While America is blessed with abundant natural resources, those resources must be effectively managed, and our water infrastructure must be modernized to meet the needs of current and future generations.

Executive departments and agencies (agencies) that engage in water-related matters, including water storage and supply, water quality and restoration activities, water infrastructure, transportation on our rivers and inland waterways, and water forecasting, must work together where they have joint or overlapping responsibilities. This order will ensure that agencies do that more efficiently and effectively to improve our country’s water resource management, modernize our water infrastructure, and prioritize the availability of clean, safe, and reliable water supplies.

And the EO created an Interagency Water Subcabinet:

Sec. 3. Interagency Water Subcabinet. To promote efficient and effective coordination across agencies engaged in water-related matters, and to prioritize actions to modernize and safeguard our water resources and infrastructure, an interagency Water Policy Committee (to be known as the Water Subcabinet) is hereby established. The Water Subcabinet shall be co-chaired by the Secretary of the Interior and the Administrator of the Environmental Protection Agency (Co Chairs), and shall include the Secretary of Agriculture, the Secretary of Commerce, the Secretary of Energy, the Secretary of the Army, and the heads of such other agencies as the Co-Chairs deem appropriate. The Department of the Interior or the Environmental Protection Agency (EPA) shall, to the extent permitted by law and subject to the availability of appropriations, provide administrative support as needed for the Water Subcabinet to implement this order.

I was surprised as I did not know that Mr. Trump was that taken with water. The Water Subcabinet strikes me as a good idea and might encourage collaboration among Federal departments and agencies. In fact, an organization already exists to do that: the Water Resources Council. It was created in 1965 but was totally defunded in 1983 during the Reagan years, although it still exists on paper.

Brief History of the Water Resources Council

U.S. water resource agencies largely acted autonomously in proposing project plans until an interagency Water Resources Council was established in 1965 to coordinate federal water programs and policy. The Council was created by the Water Resources Planning Act of 1965 (P.L. 89-80); it challenged more established institutional decision mechanisms of both executive and legislative branches and was subsequently disbanded in 1983. The 1965 act declares that “the policy of the Congress is to encourage the conservation, development, and utilization of water and related land resources of the United States on a comprehensive and coordinated basis by the Federal Government, States, localities, and private enterprise ..." Specific duties given the Council were to:

 conduct continuing "assessments" of water supplies;

 coordinate basin plans with larger regional and federal programs, including making policy

recommendations;

 establish "principles and standards" for evaluating projects, i.e., integrating environmental and social objectives with cost-benefit analysis;

 review and make recommendations on basin commission plans; and

 allot financial grants to states for planning assistance. Council Activities, 1968-1978

With 50 professional staff, the Council issued unprecedented and highly detailed national water assessments in 1968 and in 1975. Dozens of river basin studies and major planning studies were completed, as was issuance of new principles and standards for project evaluation.

The Council operated in an environment dominated by a few large water project construction agencies and the legislative committees of jurisdiction. Although the Council operated as a sub-Cabinet (staff-level) committee, it was nominally made up of the Secretaries of Agriculture, Army, Health, Interior, and Transportation and the (then) Federal Power Commission chairman; later the Housing Secretary and Administrator of the Environmental Protection Agency were named as associate members, while "observers" included the Office of Management and Budget, Council on Environmental Quality, Tennessee Valley Authority, and river basin commission chairpersons.

In 1978, the Carter Administration initiated an effort to reform federal water policy—initially employing a "hit list" of about 20 large water projects for which de-authorization was sought. The Council was called upon to assist in the effort, and Council staff were used to independently review the water agencies’ project justifications. Eventually, congressional funding provisions maintained many projects and prohibited the Council’s independent reviews.

Early 1980s

In early 1981, Interior Secretary James Watt, serving as Council chairman, requested reduced Council funding. The action was consistent with the Reagan Administration's outlook that states should play a more active role in water policy activities. All the organizational and staff planning functions of the Council and basin commissions were disbanded, and a revised set of "Principles and Guidelines" were issued in 1983 as one of the last formal actions of the Council. Although the Water Resources Planning Act has not been repealed and thus authorization of the Council remains statutorily, no funding for the Council has been appropriated since FY1983.

I have heard that the WRC has been periodically used to enhance cooperation among agencies, as has the Water Subcabinet, even though it is only three weeks old.

So why create something when you have a perfectly good mechanism to effect change? Is the President looking for something better?

Jeff Peterson, retired EPA senior policy advisor questioned Trump's motive and noted some decisions made by the Trump Administration that fly in the face of what the EO says. Really? So what you see is not what you got.

Maybe it's time to revisit AWRA's Water Policy Dialogues from the early 2000s. Seriously.
