CRS Report: 'Supreme Court Preview of 2020-2021 Environmental and Energy Law Cases and Review of 2019-2020 Rulings'

Linda Tsang (coordinator), Kate R. Bowers, Eric N. Holmes , Stephen P . Mulligan, Adam Vann and Erin H. Ward assembled this amazing CRS report (updated: 11 February 2021): 'Supreme Court Preview of 2020-2021 Environmental and Energy Law Cases and Review of 2019-2020 Rulings'.

All the authors are attorneys. That is certainly understandable but one or two authors should have some environmental and energy knowledge from a non-legal vantage point - like Nicole Carter. Perhaps some of the six did.

I was disappointed that the Mississippi v. Tennessee groundwater case did not make the grade. It's a groundbreaking issue - the only 'groundwater only' case ever to reach the Supreme Court. Some might argue that in the first time around the case went through the Federal district/appeals courts before SCOTUS declined to hear it without prejudice. The lower courts advised Mississippi that Tennessee should be a defendant. The second time around it became MS v. TN and went right to SCOTUS. Original jurisdiction, right?

Introduction
The Supreme Court 2019-2020 term, which started on October 1, 2019, was historic in unexpected ways. The Coronavirus Disease 2019 (COVID-19) pandemic resulted in the Court indefinitely closing its building to the public, postponing oral arguments, and conducting telephonic oral arguments for the first time in history.

Beyond the effects of the pandemic, the 2019-2020 Term was notable for the substantive opinions that the Supreme Court issued on environmental, energy, and natural resources (EENR) law issues. Of particular note for Congress’s work, the Court’s term included these opinions:

 County of Maui v. Hawaii Wildlife Fund, holding that the Clean Water Act requires a permit when there is a direct discharge from a pollution source into navigable waters or when there is the functional equivalent of a direct discharge;

 Atlantic Richfield Co. v. Christian, holding that the Montana state courts had jurisdiction over the landowners’ restoration damages claim, and that EPA must approve the restoration plans because the landowners were potentially responsible parties under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA); and

 United States Forest Service v. Cowpasture River Preservation Association, holding that the U.S. Forest Service had authority under the Mineral Leasing Act to grant a natural-gas pipeline right-of-way through lands in the George Washington National Forest traversed by the Appalachian Trail.

The Supreme Court’s 2020-2021 term, which began on October 5, 2020, features cases relating to states’ competing claims to several interstate rivers, disclosure of agency documents produced during an Endangered Species Act consultation, the appropriate court to decide climate change liability suits, the small refinery exemptions under the Clean Air Act’s renewable fuel standard, the relationship between separate CERCLA provisions for recouping cleanup costs, eminent domain authority under the Natural Gas Act, and other areas of EENR law. The Court is also reviewing petitions for a writ of certiorari and complaints related to the scope of the President’s authority to declare national monuments under the Antiquities Act, a state’s denial of a water quality certification under Section 401 of the Clean Water Act, and other petitions that may implicate EENR issues. The Biden Administration is shifting executive branch policy on certain environmental, energy, and public health matters and its litigation strategies in pending cases.

In the 2020-2021 term, Justice Amy Coney Barrett began serving as the 103rd Associate Justice of the Supreme Court, filling the vacancy left by the death of Justice Ginsburg at the end of the 2019-2020 term. Legal commentators anticipate that Justice Barrett’s judicial philosophies may affect the Court’s majority views on agency deference, the scope of the federal agency’s authority to implement EENR statutes, and the justiciability of environmental claims.

This report reviews some the major EENR decisions from the Supreme Court’s 2019-2020 term and previews the legal disputes and arguments in selected EENR cases and petitions for certiorari in the 2020-2021 term. The report also highlights the broader implications of these decisions and cases for Congress.

TGIF! Weekly Water News Summary 6 -12 February 2021

At a community fire day in a northern California town several years ago, author Faith Kearns gave a talk on building fire-safe houses able to withstand increasingly common wildfires. Much to her surprise, Kearns was confronted by an audience member whose house had recently burned. What she thought was straightforward, helpful scientific information had instead retraumatized audience members, forcing Kearns to reevaluate her approach. Like Kearns, scientists today working on controversial issues from climate change to drought to COVID-19 are finding themselves more often in the middle of deeply traumatizing or polarized conflicts. It is no longer enough for scientists to communicate a scientific topic clearly. They must not only be experts in their fields of study, but also experts in navigating the thoughts, feelings, and opinions of members of the public they engage with, and with each other. And the conversations are growing more fraught.

In Getting to the Heart of Science Communication, Faith Kearns has penned a succinct guide for navigating the human relationships critical to the success of practice-based science. Using interviews and personal anecdotes, as well as her own insights as a field scientist, Kearns walks readers through the evolution of science communication and how emotional and high-stakes issues have shaped communication. The meat of the book lies in the middle chapters, where Kearns offers key tools for communicators: listening, working with conflict, and understanding trauma, loss, and healing. She concludes the book with a substantive discussion on diversity, equity, and inclusion in the sciences, and advice to readers for handling their own emotional needs in an unpredictable career landscape.

This meticulously researched volume takes science communication to the next level, helping scientists see the value of listening as well as talking, understanding power dynamics in relationships, and addressing the roles of trauma, loss, grief, and healing. This book will particularly resonate with early to mid-career scientists, graduate students, and researchers, especially those in applied sciences who work closely with the public.

Introduction
The Endangered Species Act of 1973 (ESA; P.L. 93-205, 87 Stat. 884, 16 U.S.C. §§1531-1544) aims to conserve species listed as endangered or threatened under the act. Under the ESA, it is the policy of Congress that all federal agencies shall seek to conserve threatened and endangered species, use their authorities in furtherance of the ESA, and cooperate with state and local agencies to resolve water resource issues in concert with conserving endangered species. The ESA is administered by the U.S. Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS). Under the ESA, domestic and foreign species of animals (both vertebrate and invertebrate) and plants can be listed as either endangered or threatened, according to an assessment of the risk of their extinction. Once a species is listed, the act provides tools to aid the species’ conservation and recovery and to protect its habitat.

The ESA and its predecessors have been in place since 1966. Since enactment, these acts have led to the listing of over 2,400 species as threatened or endangered. As of October 2020, 2,363 species were listed, the majority of which (71%) were listed in the United States; the remaining 29% were foreign species. Of all listed species in October 2020, 79% were endangered and 21% were threatened. As of October 2020, 91 species had been delisted under the ESA since it was enacted in 1973, which is approximately 3.7% of the total number of species ever listed under the act.

Many Members of Congress are interested in how the ESA is implemented, because states—as well as American Samoa, Guam, the Northern Mariana Islands, Puerto Rico, the Virgin Islands, outlying Islands in the Pacific and the Caribbean, and Washington, DC—have species that are, or may be in the future, listed under the act. Congress also is interested in broader issues surrounding the ESA and oversight of its implementation, primarily because some stakeholders perceive the ESA as, at times, pitting economic development against the conservation of listed species.

This report discusses selected provisions of the ESA and selected federal regulations that implement the ESA. It discusses several major provisions of the act, generally in the order they appear in the U.S. Code. These sections include Section 4, on listing species under the ESA; Section 6, on cooperating with states in recovering listed species; Section 7, on interagency cooperation and consultation; Section 9, on prohibitions under the ESA; Section 10, on exceptions to prohibitions; Section 11, on penalties and enforcement under the ESA; and Section 8, on the implementation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), among others.

The ESA has been amended numerous times since its enactment. The authorization for funding included in Section 15 of the ESA expired on October 1, 1992; nevertheless, Congress has appropriated funds in each succeeding fiscal year, and the ESA’s provisions—including those related to listings, consultations, prohibitions, and penalties—remain in effect.

A long-standing question related to the ESA is whether it effectively achieves its purposes, as outlined in the act. Various stakeholders have put forth different interpretations on this issue. Some stakeholders have offered, as evidence of the ESA’s success, the very low rate of extinction for those species listed under the act. Other stakeholders have suggested the ESA has been ineffective at conservation, noting that recovery is an integral component of success as presumed by the definition of conservation included within the act—“to bring any endangered or threatened species to the point at which the measures provided in [the ESA] are no longer necessary”; to support this position, they highlight that only a small number of species have been delisted due to recovery.

In addition to addressing whether the ESA has been successful at conserving species, stakeholders have raised other issues related to the act. These issues include, among others, the ESA’s effects on private property and landowners; the ability to conserve species before it is necessary to list them; the cost of listing species and the resulting economic impacts; the availability of funding for the ESA; incentives for conservation under the ESA; the states’ role in conserving listed species; delays in listing, delisting, and reclassifying species under the ESA; and litigation related to the ESA. Given the perennial nature of these issues and the ESA’s controversial nature, these matters are routinely of concern to Members of Congress.

Cutting to the chase...

Concluding Remarks
The ESA and its predecessors have been in place since 1966. Since enactment, these acts have led to the listing of more than 2,400 species as threatened or endangered, including species in the United States and U.S. territories and in foreign countries. As of October 2020, 2,361 species were listed, the majority of which (71%) were listed in the United States (the remaining 29% were foreign species). Of the total, 79% were listed as endangered and 21% were listed as threatened. (See Figure 1.)

As of October 2020, 91 species have been delisted under the ESA since it was enacted in 1973, which is approximately 3.7% of the total number of species ever listed under the act. FWS provided several justifications for delisting, as follows:

 Approximately 65% delisted due to recovery

 Approximately 15% delisted due to new information, changes in the law, or improved scientific understanding of the species

 Approximately 12% deemed extinct and delisted

 Approximately 8% delisted due to scientific reclassification of the species

Delisting a species took 25.4 years on average, though the time required ranged from 3.6 years to 52.9 years. When considering only those 59 species delisted solely due to recovery, delisting a species took an average of 30.6 years and ranged from 8.2 years to 52.9 years. In addition, of the currently listed species, 53 listed species have been reclassified from either endangered to threatened (downlisted; 43 species) or from threatened to endangered (uplisted; 10 species).

A long-standing question is whether the ESA effectively achieves its purposes as outlined in the act. Various stakeholders have offered different interpretations on this issue. Some have offered as evidence of the act’s success the very low rate of extinction for those species listed under the ESA. Stakeholders routinely have supported this position by stating that since the ESA’s enactment, less than 1% of listed species have become extinct (11 species have been delisted due to extinction, according to FWS) or, conversely, that over 99% of listed species have successfully been conserved. Other stakeholders have suggested the ESA has been ineffective at conservation, positing that recovery is an integral component of success as presumed by the definition of conservation included in the act—“to bring any endangered or threatened species to the point at which the measures provided in [the ESA] are no longer necessary.” To support this position, they highlight that only a small number of species have been delisted due to recovery (59 species, according to FWS). FWS has recognized both of the above stakeholder positions in defining success under the ESA, while acknowledging that the ESA is “also seen as one of the most controversial” laws.

In addition to addressing whether the ESA has been successful at conserving species, various stakeholders have raised numerous other issues related to the act, including the following:

 The ESA’s effects on private property and landowners

 The ability to conserve species before it is necessary to list them

 The cost of listing species and the resulting economic impacts

 The availability of funding for the ESA

 Incentives for conservation under the ESA

 States’ role in conserving listed species

 Delays in listing, delisting, and reclassification of species under the ESA

 Litigation related to the ESA

Given the perennial nature of these issues and the controversial nature of the ESA, these issues are routinely of concern to Members of Congress.
