My Ten Cents: Oregon Business Council Report - 'Securing Oregon's Water Future'

This report from the Oregon Business Council was released in mid-April. It was authored primarily by Duke University professor Martin Doyle, who's arguably (but no argument from me) the best person to write something like this. He interviewed many experts and others (including yours truly) about Oregon's water and its future. At the time of my interview I did not realize that it's scope was so broad; I thought it was primarily about groundwater. You can download a copy from the OBC website or below.

Introduction
For more than a decade the Oregon Business Council has recognized the value of managing Oregon’s water resources to grow our economy, protect our natural systems, and provide all Oregonians with abundant, affordable clean water. In 2013, OBC supported efforts by others to combine private and public funds to spur investments in water systems. In 2017 and 2018, OBC invested in efforts by the Harney County and North Santiam watersheds to estimate the economic value of water, value that was defined by local stakeholders to include economic, social, cultural, and natural systems benefits. While these investments in water management were important, they were only pieces of the larger water management challenge that Oregon must meet now and well into the future.

In 2019 OBC took up the challenge to comprehensively frame Oregon’s water needs for future generations. In part this was inspired by what we learned in the Harney County and North Santiam project and in part by Governor Kate Brown’s call, the year before, for a 100-Year Water Vision for Oregon. OBC began the Water Project in a fall retreat of OBC directors and water experts hosted by Scott Campbell at his Silvies Valley Ranch. In 2020 we hired nationally known water policy expert Martin Doyle to guide this effort. Doyle’s research into Oregon’s water challenges included input from as many as 75 different Oregon water scientists, advocates, and legal and policy experts. The project was led by OBC’s Water Task Force chaired by Portland General Electric CEO Maria Pope. The group included six other OBC directors and three senior executives, and it was staffed by OBC consultant John Audley. This report, endorsed by OBC’s board of directors, is the product of that effort.

The goal of the project and this report is to frame water management in a way that enables policy makers to discuss difficult but critical water issues, to apply widely accepted science, and to adopt a shared approach to modernizing Oregon’s water management systems. This report represents the start of a conversation.

Although this paper benefits from wide input, it solely represents the position of the Oregon Business Council. And it is part of a longer process. We remain open to input from others, we are willing to adjust our thinking, and we are excited to see where it takes us all.

The next phase for the OBC Water Project will be to organize field tours in key watersheds with water stakeholders and elected officials. In this format we can share the understandings we have gleaned about Oregon’s water management challenges and opportunities and discuss and develop place-based solutions designed to meet these challenges. We hope that this effort will elevate water to become a central issue for the 2022 election cycle and provide a new governor and legislature with the insights they need to bring Oregon water management into the 21st century.

SUMMARY OF FINDINGS

• Despite some constraints, Oregon has a comparative strategic advantage in water resources over other western states.

• Over-allocation and seasonal variability are putting greater pressure on both groundwater and surface water availability for all purposes, including instream environmental health.

• Increasing water service costs and decreasing federal funds are pushing up water rates, making water less affordable for low-income customers.

• Affordability challenges are exacerbated by the economic impacts of the Covid-19 pandemic and wildfires.

• The current water data management system is inadequate for water policy making, planning, management, problem solving, and investment. Agency budgets are inadequate to address this constraint.

• The prior appropriation doctrine in water law assures certainty for water users that is valuable to system stability and investment decision making.

• Water use permitting has been ineffective and inefficient, fueling adversarial conditions, inaction, and delay.

• Oregon has a history of adapting water laws, policies, and practices that respond to changing conditions and priorities, but the most significant reforms took place 25 years ago.

Because the status quo is insufficient to meet current challenges, let alone those of the future, Oregon must overhaul its water management system. Water management should be modernized across the board. New models and approaches must be adopted that reward innovation, reduce regulatory costs, and increase accountability. The primary challenge facing Oregon’s water future is water management. Because the status quo is insufficient to meet current challenges, let alone those of the future, Oregon must overhaul its water management system. Water management should be modernized across the board. New models and approaches must be adopted that reward innovation, reduce regulatory costs, and increase accountability. Such models must be far more responsive to specific needs across the breadth of our communities.

Lessons from Inside and Outside Oregon
As Oregon envisions a path forward in water management, it need not craft solutions and adaptations from scratch. It should look to other states for ideas, innovations, and lessons learned. There are also local innovations within Oregon which could be scaled statewide. Here’s a cursory look at the kinds of recent innovations Oregon might well consider.

Regionally Based Water Management
A number of states with widely varying conditions across their geography have developed a region- specific, basin-specific approach to water planning strongly grounded in science. Oregon has begun to adopt this approach as a starting point, but other states have embraced it more formally. For example, in Washington, the Yakima Integrated Plan was developed through a collaboration of irrigators, state agencies, federal agencies, and tribes. The plan is specific to the Yakima basin and is recognized by state and federal agencies, allowing a level of coordination and increased funding that would not have been possible without this jointly developed, region-specific approach. The legislation for the Yakima Integrated Plan does not pre-authorize any specific project or eliminate (or reduce) permit requirements, but it does provide a level of state and federal commitment, as well as local group coordination, that has allowed projects to proceed at a pace and scale not possible otherwise

California has taken a similar approach for groundwater through the Sustainable Groundwater Management Act (SGMA). In this case, recognizing the differences between aquifer conditions and withdrawal rates across California’s geography and geology, the state created groundwater management units (geographic areas) with plans specific to local groundwater conditions. From there, the state allowed those units to create their own management organizations (Groundwater Sustainability Agencies) and their own plans for achieving groundwater sustainability. That is, the state delegated decision making and management approaches to local entities subject to state-level priorities for sustainability. It is important to note that SGMA is very much a management approach in progress, so its implementation and adaptation can provide important lessons on the effectiveness of regional management approaches to groundwater.

Within Oregon, the Deschutes River Conservancy (DRC) provides an example that is similar in many ways to the Yakima approach. The key approach that both of these programs have adopted is to harness and maximize the benefits that come from basin-scale planning and coordination, particularly when coordinated across varying sectors (e.g., agriculture, conservation, municipal jurisdictions, tribes). The efforts of the DRC at enabling local projects to conserve water and then putting that conserved water into streams for conservation, has created opportunities to put conserved water to use where it is most needed ecologically. One of the implications for expanding this model could be to allow a watershed or basin-based organization to transfer water. This would allow water transfers to be more timely and efficient, particularly in critical windows of time. While the authority to grant or issue transfer permits may not be viable, there could be guidelines and accountability at the basin level, with a local organization having some operational flexibility within those parameters

This approach is in some ways similar to “group compliance permits”, a watershed-scale management approach used in North Carolina, New York, and Virginia (among others). Within a watershed, point sources subject to regulatory water quality permits under the National Pollutant Discharge Elimination System are grouped and assigned individual source limits, the sum of which defines a cap for the group of permit holders. Individual permit limits are waived so long as the overall sum stays below the cap. This allows flexibility, both short-term and long-term, for meeting overall regulatory requirements while increasing the feasibility of local initiatives and innovations.

It is worth noting that there are also extreme cases of regional approaches, and these involve adopting quite different regulatory approaches (and even laws) specific to a particular geographic region. At the most extreme, the state of Nevada has implemented a pilot program that has adapted the prior appropriation doctrine in a limited geographic area, the Diamond Valley. In this closed basin, where the state of Nevada has allowed irrigators (for decades) to pump more than twice the amount of water than is sustainable, the state engineer approved a groundwater management plan – specific to this basin alone – that would gradually reduce allowed pumping, eventually reaching a rate that matched recharge. The innovative aspect of the plan, however, was adopting a shares-based water rights allocation in which each share would represent a certain amount of water. Over time, the amount of water represented by each share would decrease, and over a proposed 35-year period, gradually reduce over-pumping. In addition, this approach would establish a more functional market (an approach modeled on that used in Australia). While a majority of irrigators supported the plan, as did the state engineer, (because it was preferable to curtailment) there were vocal opponents, and in the spring of 2020, a district court judge ruled that the approach contravened Nevada water laws. Thus, the approach remains untested

My Ten Cents
The above suggestions are very good and should be investigated. I am familiar with the Yakima Basin Plan and impressed with it. It is important to note that the Yakama Nation is on board. Something like this might work in the Willamette Basin, which has far more 'players' than the Yakima.

Groundwater management in Oregon is not done very well, mainly because the state has no good idea how much groundwater it has (not unusual among states). You can't manage what you don't measure. I would love to see the state obtain more funds for groundwater data acquisition. Work is now wrapping up in the Harney Basin of eastern Oregon, where locals and state, local and Federal agencies are studying the over-drafted groundwater basin. I would like to see groundwater management districts established. IWRM is very important.

Too bad the Nevada experiment is proving infeasible.

Great report - lots of information and very good suggestions. I am glad that the OBC went outside Oregon for someone like Professor Doyle to take the lead. Oregonians were involved but getting a perspective like that offered by Professor Doyle was a definite plus. I don't think Oregon's 100 Year Water Vision was produced in such a way. State agencies did the work, supplanted by Oregonians serving as community voices.  

We need to be wary of climate change and its effect on the spatial and temporal distribution and character of precipitation. 

We cannot neglect water quality. Non-point source pollution and 'forever chemicals' are especially troublesome.

Summary
Lead’s adverse health effects—especially for children, even at low levels of exposure—have driven continuing efforts to reduce lead exposure through drinking water. Primarily, lead enters drinking water after leaving the treatment plant, when lead may leach into water from plumbing materials or pipes. Accordingly, controlling corrosion of plumbing and pipes has been the principal method used to keep lead from entering public water supplies. Congress has used several approaches under the Safe Drinking Water Act (SDWA) to limit lead in drinking water. These approaches include limiting the lead content of plumbing materials and fixtures; establishing public notification and education requirements; authorizing the U.S. Environmental Protection Agency (EPA) to regulate contaminants in public water supplies; and authorizing grant programs for lead reduction projects, testing for lead in water at schools and child care programs, and removing lead-lined drinking water coolers from schools. 

Using SDWA authorities, EPA developed the 1991 Lead and Copper Rule (LCR). The LCR is unlike most drinking water regulations. It does not include a health-based standard (i.e., maximum contaminant level [MCL]); rather, the rule established a treatment technique and action levels. The LCR specifies an action level of 15 ppb for lead (and 1,300 ppb for copper), based on the 90th percentile of a water system’s tap water samples (i.e., 90% of samples collected as a part of tap water monitoring should provide water with lead and copper levels below 15 ppb and 1,300 ppb, respectively). The LCR’s treatment technique includes (1) corrosion control treatment, (2) source water treatment, (3) lead service line (LSL) replacement, and (4) public education. Unlike an MCL, an action level is not an enforceable standard, but is instead a screening tool for determining whether treatment technique actions are required. Failure to implement the required actions is enforceable. 

Since promulgation of the LCR, lead exposures from drinking water have declined in the United States. However, ongoing detections of lead in drinking water and issues with implementation and interpretation of the LCR, as well as scientific and technological advancements, have generated interest in its revision. EPA issued interim revisions in 2007, and has since worked with states, water systems, and other stakeholders to develop comprehensive, “long-term” revisions to the rule. 

EPA published final Lead and Copper Rule Revisions, or LCRR, in the Federal Register on January 15, 2021, with an effective date of March 16, 2021. The LCRR revises the LCR. On January 20, 2021, the Biden Administration issued a letter directing executive agencies and departments to delay for 60 days the effective date of rules published in the Federal Register that had not yet entered into effect, to allow the Administration to review such rules. After the review, EPA announced the extension of the LCRR’s effective date from March 16, 2021, to December 16, 2021, and an updated compliance date for water systems of October 16, 2024. In the preamble to the LCRR, EPA notes the need to modernize and improve the LCR by strengthening health protections and clarifying requirements to improve the rule’s effectiveness and enforceability. The LCRR retains for certain purposes the 1991 LCR’s 15 ppb lead action level. However, the LCRR also establishes a new lead “trigger level” at 10 ppb, based on the 90th percentile of tap water samples. 

Because the trigger level is more stringent than the action level, the LCRR requires public water systems to take treatment technique actions at lower lead levels than those required by the LCR. The LCRR also requires water systems to identify LSLs within their distribution system and to test for lead at schools and child care programs within their service area to better target monitoring and, as required, LSL replacement. The LCRR requires water system operators to develop an LSL replacement plan and to replace its portion of an LSL within 45 days (or 180 days with state notification) of being notified of a customer’s intent to replace their LSL portion. Further, the revisions make several changes to the sampling protocols for conducting tap water monitoring. The LCRR also includes the enhanced public notification requirements added by the Water Infrastructure Improvements for the Nation Act (WIIN; P.L. 114-322). 

The revisions may result in implementation and enforcement challenges for public water systems and states with delegated enforcement responsibility for SDWA. Some systems may experience implementation challenges when complying with the revisions; for example, public water systems may need additional financial resources to meet the LSL replacement requirements. The revised rule’s alternative compliance options for small water systems could pose particular challenges to states, as states may need additional resources to evaluate, approve, and track each system’s implementation.

Summary
Communities may face a range of issues associated with aging water infrastructure, including elevated lead levels in tap water. Because of lead’s toxicity, even at low levels, reducing lead exposures from drinking water and other sources remains a public health priority. Other sources of lead exposure include lead-based paint and contaminated soil and dust from deteriorated lead-based paint. Nationally, the phaseouts of leaded gasoline and lead-based paint, along with regulatory controls and technical changes, have reduced lead exposures. Since the late 1970s, overall blood lead levels in children (ages one to five) have declined an estimated 94%.

Sources of Lead in Drinking Water
Most contaminants, when found in public water supplies, are detected and treated at the water treatment facility. In contrast, lead occurs in tap water after treated water enters the distribution system, where water is corrosive and lead can leach from pipes, plumbing materials, and fixtures (e.g., faucets). Corrosion is a chemical reaction between the water and the plumbing materials. Factors affecting corrosion include the water’s acidity, temperature, water use patterns, and the presence or absence of protective coatings of mineral deposits that can accumulate inside pipes, among others. Accordingly, controlling corrosion has been the principal method used to keep lead in tap water.

The presence of leaded pipes and materials in community water systems (CWSs) and homes generally depends on the age of the water system and residences. Before the 1930s, lead pipes were commonly used to extend water service from the water main under the street to a residence or other building inlet. These lead pipes are known as lead service lines (LSLs). Nationwide LSL estimates vary. A 2016 analysis estimated that the number of LSLs nationwide declined from approximately 10 million to 6 million over three decades. EPA estimates that the current number of LSLs may range from 6.3 million to 9.3 million. Leaded plumbing materials (e.g., brass fixtures and copper pipes with lead solder) in buildings, such as child care facilities and residences, can also contribute to lead in drinking water.

My latest post on this issue was last November (see here) when Special Master Eugene Siler ruled in Tennessee's favor. States' feud delivers Supreme Court's first groundwater test

The Supreme Court may hear its first groundwater battle later this year — and the case could force the justices to consider an unusual claim.

Unlike other interstate water wars that reach the high court, Mississippi has argued that it has sole legal rights to groundwater in an aquifer that straddles the Tennessee border.

The claim is a novel departure from the Supreme Court's traditional approach of dividing water supplies equitably and has set off alarm bells for other states that share water with their neighbors.

Mississippi's argument: For decades, Memphis Light, Gas and Water Division has unlawfully sucked up billions of gallons of groundwater in a sub-unit of the Middle Claiborne Aquifer that is exclusively owned by the Magnolia State.

The result is a massive drawdown in the aquifer — known as a "cone of depression" — that makes it so Mississippi has to dig deeper and more expensive wells to bring the water it needs to the surface. Because the resource has already been unfairly developed, Mississippi argues, the remainder of the aquifer's water can't now be fairly divided. The state is seeking more than $600 million in damages.

"What Tennessee has done is robbed the ability of the people of Mississippi to fully develop the aquifer," said Richard Spruill, principal hydrogeologist and president of Groundwater Management Associates Inc. in North Carolina. Spruill has worked as an expert for Mississippi in the case.

The fight is one of a slew of interstate water wars that have reached the nation's highest bench in recent months. The disputes invoke the Supreme Court's original jurisdiction to resolve legal battles between states.

During the 2020 term, which ends this summer, the justices reviewed fights between Texas and New Mexico over stored floodwaters on the Pecos River and between Florida and Georgia over flows through the Apalachicola-Chattahoochee-Flint (ACF) River Basin.

Many more such cases are expected to come up as the planet warms and water supplies dry up (Greenwire, May 6, 2020).

Mississippi v. Tennessee is the first groundwater case to reach the Supreme Court.

Mississippi's novel argument is unlikely to fly with the justices, who use the legal doctrine of equitable apportionment — or fair distribution — to divvy up water between states, said Robin Kundis Craig, an incoming law professor at the University of Southern California.

"Pretty much everyone is lined up against Mississippi to say: 'You're making a stupid argument,'" she said.

The Biden administration, a group of law professors and a bipartisan coalition of eight states are backing Tennessee in the aquifer battle.

No one has gotten involved on behalf of Mississippi.

Because equitable apportionment is a forward-looking remedy, it makes sense that Mississippi wouldn't root its arguments in

that doctrine if the state wants to be paid for past withdrawals from the aquifer, said Dave Owen, a professor at the University of California, Hastings College of the Law.

But it has a long, uphill battle if it wants to convince the Supreme Court to deviate from that approach, he said.

"This is a court that wants to rule on grand constitutional questions," Owen said. "It doesn't want to be a water rights court."

Special master's view

Tennessee has one other key expert in its corner — the "special master" the Supreme Court has assigned to decide how the groundwater in the aquifer should be shared.

In a November 2020 report, Senior Judge Eugene Siler Jr. for the 6th U.S. Circuit Court of Appeals found that the aquifer is in fact a continuous interstate resource and that equitable apportionment is the appropriate mechanism to divide it.

"When states fight over interstate water resources, equitable apportionment is the remedy," wrote Siler, who was appointed during the George H.W. Bush administration. "Mississippi presents no compelling reason to chart a new path for groundwater resources."

He gave Mississippi a shot at amending its complaint. For more than a decade, the state has held firm in its argument that it is the sole owner of the aquifer and that Tennessee has stolen its water.

Mississippi declined to change its position. The water, the state says, moves through the ground so slowly that it was never naturally available to Tennessee and is now forever lost to Mississippi.

Earlier this year, the state filed exceptions to Siler's report, a step that is expected to prompt the Supreme Court to take a closer ook at the dispute.

Drawdown by the Memphis utility, under Tennessee's supervision, means that the aquifer must recharge using younger — and potentially contaminated — water, Mississippi wrote. It has also reduced the amount of groundwater a well in Mississippi can recover, the state said.

The reduction, Mississippi wrote, "means that more wells and more pumps — at great expense — are required to recover the water needs of Mississippi's producers; and the power costs of those producers have also been increased."

Tennessee filed its own reply urging the justices to reject Mississippi's claims.

"This is the third attempt by Mississippi to seek more than $600 million in alleged damages concerning groundwater in the Memphis Sands Aquifer, which is an underground water resource that underlies parts of both Mississippi and Tennessee," wrote lawyers for the Volunteer State.

"Mississippi, however, still cannot plead or prove that a single Mississippi resident has suffered a water shortage from Memphis's use of the Aquifer," Tennessee continued.

'Dangerous uncertainty'

Other states that share water with their neighbors are pleading with the Supreme Court not to side with Mississippi's unusual claim to exclusive rights over the aquifer.

Eight states led by both Democratic and Republican attorneys general joined forces earlier this year to argue that penalizing Tennessee for pumping without first establishing terms for use of the aquifer would create "dangerous uncertainty" for other water-sharing states (Greenwire, May 3).

"If states can be liable for damages even without a known duty to another state, then they cannot plan for the future or effectively regulate natural resources use within their borders," the states wrote in their "friend-of-the-court" brief.

"The Court should not create a new way for states to resolve their disputes over natural resource use that addresses past violations of unknown duties and does not solve the problem of how states can share a natural resource going forward," they continued.

Colorado, whose Rocky Mountains serve as the starting point for several major river systems, led the multistate brief. Idaho, Nebraska, North Carolina, North Dakota, Oregon, South Dakota and Wyoming also joined.

A ruling for Mississippi would leave municipalities and farmers in other parts of the country vulnerable to sudden water claims by neighboring states, the state coalition wrote. Such an outcome would suppress investment and increase the cost of any business venture that depends on water for its operations.

The Justice Department and a group of law professors also submitted amicus briefs in favor of Tennessee in the case.

The International Law Committee of the New York City Bar Association wrote a brief in support of neither party but noted that the court could use international groundwater law as a framework for deciding whether equitable apportionment applies in Mississippi v. Tennessee.

"Consider that, under international law, if the Middle Claiborne Aquifer crossed an international boundary, it would be subject to the principle of 'equitable and reasonable utilization,'" the committee wrote in its brief.

The principle, the brief continued, "is fundamentally similar to the Court's doctrine of equitable apportionment."

What next?

The Supreme Court could hear arguments in Mississippi v. Tennessee as early as this fall, and legal experts say the justices could come to a quick — and potentially unanimous — conclusion in the case.

Interstate water disputes don't tend to divide the justices along ideological lines, and the court handed back swift and unanimous opinions in the Texas v. New Mexico and Florida v. Georgia water cases this term.

Mississippi's fight could also bounce back and forth between the Supreme Court and the special master for years to come, as did

Florida and Georgia's battle over the ACF River Basin. This term's ruling in favor of upstream Georgia in the case was the high court's second in the yearslong legal war (Greenwire, April 1).

And while Mississippi's groundwater fight may be the first to reach the Supreme Court, said Craig of USC, it won't be the last.

Just as the high court is expected to take up an increasing number of surface water disputes as the planet warms, groundwater battles will also become more heated and more frequent, she said.

One potential battleground is the massive Ogallala Aquifer underlying eight states in the middle of the United States. The aquifer sits beneath states such as Colorado, New Mexico and Texas that are already gripped by drought and competing for increasingly scarce river flows.

"When people can't get to surface water," Craig said, "they turn to groundwater."

My money's on Tennessee. Seriously - I'd love to see MS, TN and AR get together and develop a water management & governance plan by which all three collaborate to ensure sustainable development and aquifer protection. This would (I think) be a first in the USA in terms fo interstate groundwater management.  The three states were meeting in 2005 to see about collaborating when MS withdrew from the talks and filed suit against Memphis in 2006.
