TGIF! Weekly Water News Summary 4 - 10 September 2021

I am providing a copy of a one-pager by editor Susan Goldberg from the September 2021 issue of National Geographic. Its title is 'Pausing to Remember'.

If you’re age 30 or older, you probably remember what you were doing when you heard about the events of September 11, 2001. It’s one of those indelible, where-were-you moments, like the attack on Pearl Harbor or the Kennedy assassination for earlier generations.

This month, we commemorate the 20th anniversary of “9/11”—that instantly recognizable, vastly inadequate shorthand to describe a day that killed nearly 3,000 people and launched the longest war in modern U.S. history.

Two stories in this issue explore 9/11. One’s an on-the-ground report from Afghanistan. The other features still life photography of seemingly ordinary objects—a pair of boots, a watch, a snapshot—that aren’t ordinary at all. These objects, some never before displayed, came from the rubble of the World Trade Center in New York, a field in Shanksville, Pennsylvania, and the Pentagon in Arlington, Virginia. Those were the sites where al Qaeda terrorists crashed hijacked planes, instantly creating a frightening new world.

The plane that hit the Pentagon was American Airlines Flight 77, bound for Los Angeles. At 9:37 a.m., five hijackers slammed it into the building’s west side, killing themselves, 59 others aboard, and 125 on the ground. Among the dead were eight people traveling to an ecology conference sponsored by National Geographic. Every year on September 11, at our Washington, D.C., headquarters, we pause to remember them.

Three of the National Geographic travelers were 11 years old: Bernard Brown, Asia Cottom, and Rodney Dickens, each with a future whose promise would never be realized. Each child had been selected to attend the conference. Each child, according to tributes written at the time, was smart, determined, kindhearted. Today, when Bernard, Asia, and Rodney would be 31 years old, it’s devastating to think of our collective loss.

On 9/11 we also lost three caring teachers: Sara Clark, James Debeuneure, and Hilda Taylor, who accompanied the students. Sara, 65, and her fiancé were making wedding arrangements. James, 58, a father and grandfather, enjoyed golf and collecting art. Hilda, 58, a mother and grandmother, loved to cook and work in her garden.

The others whose passing we mourn were National Geographic employees. Ann Judge, 49, arranged trips around the world for our journalists and executives; Joe Ferguson loved teaching children about geography. He was 39.

We salute those we lost 20 years ago with this quote from the Pentagon 9/11 Memorial: “We claim this ground in remembrance of the events of September 11, 2001. To honor the 184 people whose lives were lost, their families, and all who sacrifice that we may live in freedom. We will never forget.”

Ann Campana Judge was my younger sister. She is on the far right in the picture. I was teaching my Environmental Studies class at the University of New Mexico Tuesday morning when I saw Mary Frances standing in the back of the room. I knew something was amiss. She told me that American Airlines called to say that Ann had a boarding pass for flight 77. They could not verify that she was on the plane. They called later that night to verify that she was. I miss Annie each day.

Summary
Wildfires are unplanned and unwanted fires, including lightning-caused fires, unauthorized human-caused fires, and escaped prescribed fire projects. States are responsible for responding to wildfires that begin on nonfederal (state, local, and private) lands, except for lands protected by federal agencies under cooperative agreements. The federal government is responsible for responding to wildfires that begin on federal lands. The Forest Service (FS)—within the U.S. Department of Agriculture—carries out wildfire management and response across the 193 million acres of the National Forest System (NFS). The Department of the Interior (DOI) manages wildfire response for more than 400 million acres of national parks, wildlife refuges and preserves, other public lands, and Indian reservations.

Wildfire statistics help to illustrate past U.S. wildfire activity. Nationwide data compiled by the National Interagency Coordination Center (NICC) indicate that the number of annual wildfires is variable but has decreased slightly over the last 30 years and the number of acres affected annually, while also variable, generally has increased (see Figure 1). Since 2000, an annual average of 70,600 wildfires has burned an annual average of 7.0 million acres. This figure is more than double the average annual acreage burned in the 1990s (3.3 million acres), although a greater number of fires occurred annually in the 1990s (78,600 average).

Issues for Congress include the strategies and resources used for wildfire prevention, mitigation, and management, and the impact of wildfires on both the quality of life and the economies of communities surrounding wildfire activity. Other issues relate to post-wildfire recovery and site restoration. Congress also considers the total federalcost of wildfire management, including the cost of suppression operations; these costs vary annually and are difficult to predict.

Summary
The diminishment of Arctic sea ice has led to increased human activities in the Arctic, and has heightened interest in, and concerns about, the region’s future. The United States, by virtue of Alaska, is an Arctic country and has substantial interests in the region. The seven other Arctic states are Canada, Iceland, Norway, Sweden, Finland, Denmark (by virtue of Greenland), and Russia.

The Arctic Research and Policy Act (ARPA) of 1984 (Title I of P.L. 98-373 of July 31, 1984) “provide[s] for a comprehensive national policy dealing with national research needs and objectives in the Arctic.” The National Science Foundation (NSF) is the lead federal agency for implementing Arctic research policy. The Arctic Council, created in 1996, is the leading international forum for addressing issues relating to the Arctic. The United Nations Convention on the Law of the Sea (UNCLOS) sets forth a comprehensive regime of law and order in the world’s oceans, including the Arctic Ocean. The United States is not a party to UNCLOS.

Record low extents of Arctic sea ice over the past decade have focused scientific and policy attention on links to global climate change and projected ice-free seasons in the Arctic within decades. These changes have potential consequences for weather in the United States, access to mineral and biological resources in the Arctic, the economies and cultures of peoples in the region, and national security.

The geopolitical environment for the Arctic has been substantially affected by the renewal of great power competition. Although there continues to be significant international cooperation on Arctic issues, the Arctic is increasingly viewed as an arena for geopolitical competition among the United States, Russia, and China.

The Department of Defense (DOD) and the Coast Guard are devoting increased attention to the Arctic in their planning and operations. Whether DOD and the Coast Guard are devoting sufficient resources to the Arctic and taking sufficient actions for defending U.S. interests in the region has emerged as a topic of congressional oversight. The Coast Guard has two operational polar icebreakers and has received funding for the procurement of two of at least three planned new polar icebreakers.

The diminishment of Arctic ice could lead in coming years to increased commercial shipping on two trans-Arctic sea routes—the Northern Sea Route close to Russia, and the Northwest Passage close to Alaska and through the Canadian archipelago—though the rate of increase in the use of these routes might not be as great as sometimes anticipated in press accounts. International guidelines for ships operating in Arctic waters have been recently updated.

Changes to the Arctic brought about by warming temperatures will likely allow more exploration for oil, gas, and minerals. Warming that causes permafrost to melt could pose challenges to onshore exploration activities. Increased oil and gas exploration and tourism (cruise ships) in the Arctic increase the risk of pollution in the region. Cleaning up oil spills in ice-covered waters will be more difficult than in other areas, primarily because effective strategies for cleaning up oil spills in ice-covered waters have yet to be developed.

Large commercial fisheries exist in the Arctic. The United States is working with other countries regarding the management of Arctic fish stocks. Changes in the Arctic could affect threatened and endangered species, and could result in migration of fish stocks to new waters. Under the Endangered Species Act, the polar bear was listed as threatened on May 15, 2008. Arctic climate change is also expected to affect the economies, health, and cultures of Arctic indigenous peoples.

Issues for Congress

Climate Change and Loss of Arctic Sea Ice
Record low extents of Arctic sea ice in 2012 and 2007 have focused scientific and policy attention on climate changes in the high north, and on the implications of projected ice-free40 seasons in the Arctic within decades. The Arctic has been projected by several scientists to be ice-free in most late summers as soon as the 2030s.41 This opens opportunities for transport through the Northwest Passage and the Northern Sea Route, extraction of potential oil and gas resources, and expanded fishing and tourism (Figure 3).

More broadly, physical changes in the Arctic include warming ocean, soil, and air temperatures; melting permafrost; shifting vegetation and animal abundances; and altered characteristics of Arctic cyclones. All these changes are expected to affect traditional livelihoods and cultures in the region and survival of polar bear and other animal populations, and raise risks of pollution, food supply, safety, cultural losses, and national security. Moreover, linkages (“teleconnections”) between warming Arctic conditions and extreme events in the mid-latitude continents are increasingly evident, identified in such extreme events as the heat waves and fires in Russia in 2010; severe winters in the eastern United States and Europe in 2009/2010 and in Europe in 2011/2012;42 and Indian summer monsoons and droughts. Hence, changing climate in the Arctic suggests important implications both locally and across the Hemisphere.

Summary
Congress created a new authority for the Bureau of Reclamation (Reclamation, part of the Department of the Interior) to build new water storage projects in Section 4007 of the Water Infrastructure Improvements for the Nation Act (WIIN Act; P.L. 114-322). The authority provides federal support for the construction of new and augmented surface water storage projects in the 17 arid reclamation states. As of August 2021, Congress had appropriated $603 million for these projects, and Reclamation had allocated (and Congress had approved) more than half of these funds to 12 projects in 3 states. Allocation of remaining appropriations is subject to further congressional action.

Background
Traditionally, Reclamation’s role in water project development had been limited to geographically specific projects authorized in federal statutes (federal law that applies to reclamation projects generally is referred to as reclamation law). Congress provided full, up-front funding for the construction costs of these facilities through discretionary appropriations to Reclamation. Project beneficiaries (i.e., irrigators, municipal water suppliers, and hydropower contractors) would then repay their portion of “reimbursable” project construction or development costs over a 40-50 year term. The amount of the up-front investment recouped by the federal government typically depends on several factors, including the portion of project benefits that are classified as fully or partially nonreimbursable (e.g., fish and wildlife enhancements, flood control, recreation) and adjustments for irrigators’ ability to pay.

Section 4007 of the WIIN Act
Congress enacted a new authority for Reclamation to support water storage projects under Section 4007 of the WIIN Act. The act authorized a total of $335 million in discretionary appropriations for new and improved water storage projects, and it used a different approach than under traditional reclamation law.

Funding for water storage projects under Section 4007 is available for two primary project types. Federally owned storage projects (surface water or groundwater storage projects to which the United States holds title and which were authorized to be constructed pursuant to reclamation law and regulations) may be no more than 50% federally funded. State-led storage projects (surface water or groundwater storage projects constructed, operated, and maintained by states or political subdivisions) may be no more than 25% federally funded. Prior to the WIIN Act, Congress had not authorized Reclamation to fund state-led water storage projects. [Click on the table to enlarge it.]

Before projects can be constructed under the authority, several milestones must be met. The Secretary of the Interior must find that the project is feasible and provides benefits proportionate to the federal government’s cost share, and project sponsors must agree to pay their portion of project costs up front. Appropriations under the Section 4007 authority are available only after the Secretary transmits a list of recommended projects and funding levels to Congress, and Congress designates those projects by name in an enacted appropriations act.

Any project that meets the WIIN Act criteria initially is eligible for funding allocations. However, Congress also stipulated that in order to move forward, the Secretary must find projects feasible by January 1, 2021, and projects must initiate construction by December 17, 2021.

Cutting to the chase...

Issues for Congress
The Biden Administration may continue proposing project-level allocations for remaining Section 4007 appropriations. Similar to prior lists, these allocations would requirecongressional approval in appropriations legislation. Significantly more future appropriations would be required to complete ongoing WIIN Act projects under Section 4007.
