Introduction
Carbon capture and direct air capture (DAC) have gained prominence in recent years as options to address climate change. The two technologies have similarities (beyond their names), but they also have differences. Key differences include how the technologies work, where the technology can be used, how the technology can address climate change, and levels of federal support. 

Congress affirmed its support for these technologies in Section 40301 of the Infrastructure Investment and Jobs Act (IIJA; P.L. 117-58): “carbon capture and storage technologies are necessary for reducing hard-to-abate emissions from the industrial sector, which emits nearly 25 percent of carbon dioxide emissions in the United States ... carbon removal and storage technologies, including direct air capture, must be deployed at large-scale in the coming decades to remove carbon dioxide directly from the atmosphere ... large-scale deployment of carbon capture, removal, utilization, transport, and storage—is critical for achieving mid-century climate goals; and will drive regional economic development, technological innovation, and high-wage employment.”

The following analysis explains key differences between the two technologies to inform ongoing congressional deliberations regarding the merits of these technologies, rationale for federal support, and funding level considerations. Additional information, such as costs and other challenges, is provided in other CRS resources, listed below.

How Do They Work?
Carbon capture technologies prevent the release of carbon dioxide (CO2) to the atmosphere. In the most commonly used arrangement today, a chemical that can “grab” CO2 is placed in or near the stream of CO2 at a source. The captured CO2 is then released and compressed so that it can be transferred by pipeline. The CO2 can then be used, for example, as a feedstock to an industrial process or permanently stored (sequestered) underground. The chemical that does the capturing can be used repeatedly in the process. The full process is called carbon capture, utilization, and storage (CCUS), or sometimes carbon capture and storage (CCS).

Direct air capture technologies remove CO2 from the atmosphere, even if that CO2 was released many years ago. In many technological approaches, air is forced over a chemical that can “grab” CO2. DAC and CCUS may use the same chemicals, but some chemicals are better suited for each application. Regardless, the supporting equipment must be optimized for the different CO2 concentrations involved in DAC and CCUS. After capture, the process for DAC is very similar to that used for CCUS and can use thesame equipment for compression, transfer, and storage. The chemical that does the capturing can also be used repeatedly.

Both technologies are in early stages of development, with a few examples of operating projects worldwide. Of the two, CCUS is more mature, though researchers expect significant technology advancement can still be achieved.

Although the capture technologies are different for CCUS and DAC, they face similar challenges. Both are typically capital-intensive and energy-intensive. Also, the demand for CO2 is small compared to its availability, resulting in low CO2 revenues. The low value of CO2 presents a hurdle to commercialization for both technologies.

Where Can They Be Used?
CCUS can be used at stationary sources of CO2 such as power plants or other industrial facilities. Existing facilities can be retrofitted to add CCUS equipment, or CCUS can be integrated into the design of new facilities. The type of source can affect the cost of a project because different sources emit CO2 in different concentrations (purities). All else being equal, carbon capture can be completed at lower cost per ton of CO2 captured for sources with higher-purity CO2 emissions (e.g., ethanol production plants). Sources of captured CO2 are often located far away from where CO2 may be used or stored, creating logistical and cost challenges related to the transport of CO2.

DAC can be used anywhere. Many proposals envision building DAC projects close to either inexpensive electricity sources or locations where CO2 can be used or stored, reducing overall costs.

With enactment of H.R. 3684, the Infrastructure Investment and Jobs Act in early November, the nation should soon feel a real kick-start in rehabilitating and updating the nation’s water infrastructure. This act reauthorizes a number of existing drinking water programs, appropriates expanded funding for water infrastructure and other programs, and commits $15 billion for lead service line replacement.

Now comes the challenge of implementing the programs in the bill. Staff at the U.S. Environmental Protection Agency (EPA) will have to develop guidance and policies for dispersing the funds, and since a lot of the funds are then to be distributed via each state’s state revolving loan fund (SRF) program, those agencies will have to accept and process applications. In other words, money will not immediately be flowing from Washington. However, EPA water staff told AWWA staff this week that ever since the Senate passed this bill last summer, they have been preparing to administer programs within H.R. 3684

AWWA issued a statement thanking Congress and the President for their support of water infrastructure. Here are some highlights of the legislation: 

Drinking Water Authorizations (Note that authorization is an initial step; the actual release of funds requires appropriations legislation, which is also in this bill, listed after this section):

 $75 million for technical assistance and grants for emergencies affecting public water systems, including natural hazards and cybersecurity

 $14.65 billion for the drinking water state revolving fund (SRF) program for fiscal years 2022-2026

 $510 million in assistance for small and disadvantaged communities

 $500 million for reducing lead in drinking water by removing lead service lines and other relevant activities, with an emphasis on assisting disadvantaged communities

 $250 million to improve operational sustainability of small water systems

 $250 million for the mid-size and large drinking water system resilience and sustainability program

 A needs assessment for a nationwide low-income water bill assistance program

 40 pilot projects to provide financial assistance to low-income water customers

 $200 million for lead testing and remediation in schools

 $5 million for water workforce efforts; applies to drinking water and wastewater

 $50 million for a study assessing emerging technologies that could address cybersecurity and water monitoring issues and a grant program to deploy technologies

Drinking Water Appropriations

 $50 million annually for the Water Infrastructure Finance and Innovation Act programs for FY2022-2026

 $11.713 billion for the drinking water SRF; 49 percent to be in the form of grants or loans with principal forgiveness; only 10 percent state match required in

FY2022 and FY2023 (the wastewater SRF program got an equal amount)

 $15 billion for lead service line replacement, with 49 percent to be in the form of grants or loans with principal forgiveness; no state match required; $3 billion annually for FY2022-20226

 $4 billion to be channeled through the drinking water SRF for emerging contaminants, all in the form of grants or principal forgiveness

 $5 billion to deal with emerging contaminants in economically distressed communities

 $1.126 annually in additional funding for the drinking water SRF through FY2026

 $1.6 billion annually in additional funding for the wastewater SRF through FY2026

Related Appropriations

 $50 million for Underground Injection Control grants to support state efforts

 $1.5 billion for Brownfields activities under the Comprehensive Environmental Response, Compensation and Liability Act

Cybersecurity

 EPA and the U.S. Cybersecurity and Infrastructure Security Agency (CISA) are to identify public water systems, that if degraded or rendered inoperable, would lead to significant impacts on the public’s health and safety

 EPA and CISA are to develop a technical cybersecurity plan support plan for public water systems

 The two agencies are to submit to Congress a list of public water systems needing technical support

Buy America, Build America

 Extends “Buy American” requirements to include not only steel and iron products, but “manufactured products” and “construction materials” as well

 “Produced” in the U.S. means a product was manufactured in the U.S. and the cost of its components that are mined, produced or manufactured in the U.S. is greater than 55 percent of the total cost of the manufactured product.

 Waivers may be granted if the iron, steel or manufactured product are not produced in the U.S. in sufficient and reasonably available quantities or of “satisfactory” quality

Wastewater Authorizations

 $14.65 billion for the wastewater SRF program; FY 2022-2026

 $1.4 billion for grants through FY 2026 to municipal entities to control and treat sewer overflows and stormwater and to provide public notification systems for such overflows

 $250 million through FY 2026 for grants to private, non-profit organizations to provide assistance to low-to-moderate income individuals for the construction, repair or replacement of an individual household decentralized wastewater treatment system or for the installation of a larger decentralized wastewater system designed to provide treatment for two or more households

 $200 million through FY 2026 for a grant program to help low-to-moderateincome individuals connect to a publicly owned treatment works

 $125 million through FY 2026 to establish a clean water infrastructure resiliency and sustainability program to address natural hazard or cybersecurity vulnerabilities

 $125 million through FY 2026 to continue a pilot program to help municipal, industrial or agricultural interests find alternative sources of water in areas experiencing critical water supply needs

 $100 million through FY 2026 to establish a pilot wastewater efficiency grant program for owners or operators of publicly owned treatment works to carry out projects that create or improve waste-to-energy systems.

 $75 million through FY 2026 for a competitive grant program to establish systems that improve the sharing of information concerning water quality, water infrastructure needs, and water technology, including cybersecurity technology, between states or among counties and other units of local government within a state

 $50 million through FY 2026 for a circuit rider program to provide assistance to owners and operators of small and medium-sized publicly owned treatment works

 EPA must establish a Water Reuse Interagency Workgroup to develop and coordinate actions, tools, and resources to advance water reuse across the U.S., including through the implementation of the February 2020 National Water Reuse Action Plan

 EPA is to establish three to five Centers of Excellence for Stormwater Control Infrastructure Technologies

 Subject to the availability of funds, EPA would conduct a study of existing and potential future technology, including technology that could address cybersecurity vulnerabilities, that enhances or could enhance the treatment, affordability, efficiency, and safety of wastewater services provided by a treatment works

 $25 million through FY 2026 for research on enhanced aquifer use and recharge in support of sole-source aquifers

 $5 million for an assessment of capital improvement needs for watersheds

Wastewater Appropriations

 $11.713 billion through FY 2026 for the Clean Water Act state revolving loan fund program

 $1 billion through the Clean Water SRF program to address emerging contaminants

Other Authorizations

 $118 million for the U.S. Department of Agriculture to conduct watershed rehabilitation

 $300 million for USDA to repair damages to waterways and watersheds due to natural disasters

The American Water Works Association (AWWA) appreciates the opportunity to comment on the EPA Strategic Plan for 2022-2026. Our comments below are organized by the relevant sections of the strategic plan.

Goal 1: Tackle the Climate Crisis (pages 7-19)

EPA should, within the confines of its authority, assist water systems and others in increasing efficiency to reduce emissions of greenhouse gases, to improve data and information available to support decision-making as communities adapt to climate change, and assist with adapting to existing and future water resource challenges. However, it is unclear what authorities and resources EPA plans to use to assist water systems with these goals. EPA has previously developed decision support tools with mixed success. There are likely opportunities for additional research and data collection and dissemination that would be of assistance. Although additional funding will be needed to actualize the research program.

For objective 1.3 (Advance International and Subnational Climate Efforts), AWWA appreciates the specific mention of assistance with “adaptation and resilience strategies for … building resilient water infrastructure, managing flood and fire risk, and mitigating public health impacts of natural disasters and other extreme weather events.” Addressing both short-term and long-term needs related to adaptation and resilience is essential for the water sector (and other sectors which interface with the water sector). We encourage EPA to provide additional information on how the Agency plans to continue, expand, or modify such efforts to reach these goals. EPA is not a water resource management agency. Nor does EPA direct infrastructure investments. Therefore, it is unclear what approach(s) are being proposed here. Additional detail is needed to understanding EPA’s proposed plans and assess their viability.

Goal 5: Ensure Clean and Safe Water for All Communities (46-56)

On page 46 there is a mention that “EPA will also address a critical public health issue by working with states and water utilities to remove lead service lines that contribute to high lead levels in drinking water. EPA will help utilities identify their lead service lines and work with federal and state funding authorities tohelp utilities

remove the lines.” AWWA agrees as to the criticality of solving issues around high lead levels and the replacement of lead service lines.

Page 49 characterizes lead service line as “the most significant sources of lead in drinking water.” This statement is overly simplistic. Lead service lines are a large potential source of lead in drinking water in areas where they exist. It is important that all sources of lead that are in contact with drinking water be removed over time. Lead-containing materials include plumbing materials and fixtures within building plumbing. Consequently, investing in removing lead over time must be balanced with ongoing efforts by water systems and customers to manage water quality to minimize corrosivity and the concentration of lead in drinking water that is consumed.

As a professional organization serving the technical education needs of the water sector and as a participant in the Lead Service Line Replacement Collaborative, AWWA has helped to identify tools to facilitate lead service line replacement. The statements in the draft plan indicate EPA plans to take an active role in assisting with lead service line inventories and lead service line removal. We encourage clarification of the Agency’s direction so that communities and individual households have a clear sense of what to anticipate as support from EPA for lead service line replacement. While there is currently legislation that will provide some funding to assist with LSL replacement, the bulk of the cost of lead service line replacement will be borne by individual homeowners and businesses either directly or through community-level fees and charges. Assistance from EPA facilitating reduction of this financial burden through its own programs and engagement of other federal funding agencies could help the sector accelerate lead service line replacement.

On page 48, there is a mention that “EPA will promote and certify water operators.” EPA does not certify water operators. Rather, licensure is completed through state agencies, which EPA could support. It is also unclear what “promote” refers to in this phrase. EPA actively works with and supports workforce development and licensure programs through its existing water sector workforce programs.1 Growing and expanding the skillset of the water sector workforce is an important objective for the sector. AWWA would appreciate EPA’s support for the ongoing efforts underway through a number of nongovernmental organizations to address the sector’s workforce needs. A more accurate framework for the EPA strategic plan would be “EPA will support water sector efforts to strengthen the sector’s workforce, promoting the importance of water operators and providing assistance to state agencies managing licensure and certification.”

Page 49 discusses PFAS. EPA recently published the PFAS Strategic Roadmap: EPA’s Commitments to Action 2021-2024,2 and it provides a path forward for how EPA intends to use regulatory authorities to address PFAS. PFAS is needed to maintain public trust in EPA processes and to gather adequate science to support the planned rulemakings.

Page 50 states that “EPA will also update and develop new health advisories and benchmarks that can be used by federal and state partners, drinking water utilities, and others to better characterize the potential health risks associated with drinking water contaminants.” Communities across the United States have experienced challenges as a result of the release of previous health advisories where there has been no opportunity for public review and comment prior to issuance. Health advisories have in recent instances become de facto standards despite the absence of analysis of the feasibility or consequences of treating them as such. EPA should place a high priority on collaborative engagement of the drinking water community including opportunities for public comment prior to release of future health advisories.

Page 51 states that “The risk to the environment and public health from cyber-attacks and the limited adoption of cybersecurity practices within the water sector gives urgency to federal-state engagement on improving the operational security of public water systems and publicly owned treatment works.” At present, the draft Strategic Plan does not recognition the critical need to engage water system owner-operators as stakeholders in crafting policies intended to mitigate cyber risks. Currently EPA is pursuing funding in the FY22 budget to expand sanitary surveys to include assessing cybersecurity resilience, yet it has not engaged the sector to identify what such an approach could accomplish and more importantly, what it is unlikely to achieve.

AWWA supports the use of a tiered, risk-based performance model to determine cybersecurity requirements for the sector. Moreover, investments in technical training and assistance, cyber-breach event reporting, communication of threat information, and funding for cybersecurity improvements should be aligned into a cohesive program. Achieving this objective will require a collaborative effort not yet reflected in EPA practice nor the draft Strategic Plan. EPA should revise the Strategic Plan to reflect an effort to ensure that all Agency efforts to advance cybersecurity are based on collaboration with water system owner-operators through the water sector’s associations and Water Sector Coordinating Council as well as other contributors to a sustainable national cybersecurity response including state primacy agencies and the Department of Homeland Security.

Page 51 notes that “EPA will also work to facilitate compliance with updated Federal Flood Risk Management Standards for critical infrastructure, which includes many water systems.” Executive Order 14030 (Climate-Related Financial Risk)4 reinstituted the FFRMS originally created under Executive Order 136905 and subsequently repealed under Executive Order 13807.6 There are complex technical and policy questions that must be addressed in implementing the FFRMS with regards to EPA programs, including capital investments made through the state revolving loan fund and Water Infrastructure

Finance and Innovation Act programs. However, EPA has taken no formal action to date towards addressing how the FFRMS will be addressed in these and other Agency programs. Consequently, there is currently nothing for EPA to “facilitate compliance” with regards to its programs. Although FEMA did issue a 2016 proposed rulemaking on FFRMS,7 it only covered FEMA programs and was formally withdrawn in 20188 and has not yet been re-established. Regardless, EPA should initiate its own stakeholder consultation and rulemaking process for the incorporation of FFRMS into its programs.

Draft Learning Agenda (pages 94-105)

With regards to EPA’s priority questions on the “drinking water systems out of compliance” learning area (pages 96-97), the following may help to inform EPA’s process for questions 1 through 39:

1. To what extent does EPA have ready access to data to measure drinking water compliance reliably and accurately?

EPA has ready access to violations data through the Safe Drinking Water Information System (SDWIS). Primacy agencies have more detailed information on compliance information through SDWIS-State and similar state-level programs. However, it is important to note that SDWIS has long-recognized limitations and concerns around the accuracy of the data reported.10 Improving the accuracy and timeliness of information available to EPA ultimately requires replacement of the existing data systems with one that allows for better data verification, which EPA has now been working on for more than a decade with limited progress.

2. What factors determine system noncompliance and continuous compliance?

Although all of the example factors listed in this discussion may be related to compliance, it is important to recognize compliance (or non-compliance) as an endpoint that does not directly measure any one factor but rather is a the result of a combination of many factors including the system’s technical, managerial, and financial (TMF) capacity, the health of its source waters (for compliance endpoints related to quality), the complexity of rule requirements (especially for non-health based endpoints), and other factors. Although it may be possible to develop a statistical model that can explain existing compliance information, its use to predict compliance at any given system is likely to be useful only as a screening-level tool for further investigation, rather than a direct predictor of compliance.

3. How can we determine if a system has the technical, managerial, and financial capacity to provide safe water on a continuous basis to its customers?

Primacy agencies have the task of and experience with engagement with systems that have challenges with TMF capacity impacting or likely to impact compliance. Because of the complexity of water system operations and the complexity of regulatory compliance, it may or may not be possible to predict compliance, but the relationships primacy agencies have can be leveraged as a way to help achieve timely return to compliance at systems that are in noncompliance.
